FilmLog Terms and Conditions & End User Agreement

1. Binding Agreement & Eligibility

These Terms and Conditions ("Terms", "Agreement") constitute a legally enforceable contract governing your acquisition, installation, access, and use of FilmLog ("Application", "Software", "we", "us"). By installing, accessing, or using the Application, you unconditionally agree to be bound by all provisions herein.

2. Strict "As-Is" Provision & Disclaimer of Warranties

The Application, its optical calculators, light metering algorithms, reciprocity formulas, and darkroom recipes are provided strictly "AS IS", "WITH ALL FAULTS", and "AS AVAILABLE". The Developer expressly disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

3. Photographic, Exposure & Chemical Results Disclaimer

• Sensor Variance: Mobile device camera sensors vary widely in spectral sensitivity, calibration, optical transmission, and automatic sensor gain. Exposure values (EV) represent mathematical estimations only.
• No Guarantee: The Developer provides zero guarantees regarding the accuracy of light meter calculations, shutter/aperture pairs, Schwarzschild reciprocity coefficients, chemical development times, or temperature offsets.
• Independent Verification: You remain solely responsible for independently verifying exposure parameters before committing irreplaceable, client, or sensitive photographic emulsions to exposure or development.

4. User Express Assumption of Risk

Analog photography entails mechanical and chemical hazards, including shutter failure, light leaks, degraded film emulsions, lab processing errors, and human operational error. You freely and voluntarily assume all risks arising from or associated with using this Application.

5. Limitation of Liability & Damage Exclusions

To the fullest extent permitted by law, in no event shall the Developer or contributors be liable for any indirect, special, incidental, consequential, or punitive damages. This exclusion explicitly covers: ruined film negatives or emulsions, ruined chemical processing, camera/lens damage, missed commercial or personal photographic opportunities, client disputes, or data loss.

6. Monetary Liability Cap ($0.00 USD)

The total aggregate liability of the Developer for any and all claims arising out of or related to this Application shall not exceed the actual monetary amount paid by you to purchase the Application, or $0.00 USD, whichever is less.

7. Local Storage & Zero Backup Responsibility

FilmLog operates strictly on local device storage. The Provider does not maintain cloud backups. You bear exclusive responsibility for maintaining independent exports of your shooting records and inventory.

8. Governing Law & Arbitration

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States. Any dispute arising under this Agreement shall be resolved through binding individual arbitration.
